1.1. These General Sales Terms and Conditions apply to any and all purchases and sales that are in any way described, mentioned, promoted or listed in the catalogue for Kreative Chocolates (“We” or “Us”) for India. Any terms and conditions not expressly included herein are excluded. By placing an order, the Customer accepts these General Sales Terms and Conditions. Kreative Chocolates reserves the right to modify the General Sales Terms and Conditions at any time. All new transactions with Kreative Chocolatesentered into after the effective date of any such modification shall be governed by the modified terms and conditions.

1.2. No additional conditions ought to be introduced by any purchaser shall be deemed applicable unless expressly accepted in writing by an authorized officer of Kreative Chocolates. The failure of to exercise one or more of its rights hereunder shall not be deemed a waiver of those or any other rights.

2.2 Order Changes and Cancellations

Once an order has been placed, cancellations or changes are generally not accepted. However, in exceptional cases, Kreative Chocolates may attempt to honor requests for changes. If a change is possible, a fee will be charged. Changes cannot be made once the shipment has been accepted by the shipping service.

2.3 Order Approval

Each order is subject to approval by Kreative Chocolates. We reserve the right to reject any order due to insufficient stock, incomplete customer information, or any other lawful reason. If there is a problem fulfilling your order, we will inform you within 2 business days of receiving it.

3.1 Pricing

Unless otherwise noted, all Kreative Chocolates pricing and charges are stated in INR, including 18% GST. Prices are subject to change.

3.2 Shipping Charges

Shipping charges are payable by the purchaser and vary by destination. Details are available upon request from Kreative Chocolates.

All purchases are subject to immediate payment by Qr code scanner, debit or credit card or mobile wallets (like Payu, Phonepe and Paytm).

The catalogue lists all products that are generally available from Kreative Chocolates. From time to time, certain items may be out of stock or unavailable. Please call us, as we may also add new products periodically. Some special gift items are unique and handcrafted and therefore available only in limited quantities. To confirm availability, please contact Kreative Chocolates before ordering.

For gift hampers, Kreative Chocolates reserves the right to substitute any unavailable item with one of equal or greater value. The presentation of gift items may be modified to ensure safe delivery and handling.

6.1 Product Shipping

6.1.1 The accuracy of the shipping information provided by the purchaser is essential to ensure proper delivery of orders. This helps ensure that Kreative Chocolates customers can enjoy our products for the full extent of their shelf life. Kreative Chocolates cannot be held responsible for incomplete or incorrect delivery instructions.

6.1.2 After an order is accepted, Kreative Chocolates will prepare it and forward it to the shipping service. While we make every effort to deliver to most specified locations, it is the purchaser’s responsibility to verify receipt with the shipping service. Failure to properly address any delivery issues with the shipping service may affect the purchaser’s ability to make a claim. Most shipping services require a signature upon delivery. Once the product is delivered according to the provided instructions, neither Kreative Chocolates nor the shipping service can be held responsible for any loss or damage caused by environmental conditions.

6.2 Shipping & Packaging Charges

6.2.1 Deliveries are made on business days and, for an extra charge, on Sundays. No deliveries are made on holidays. Hand delivery is available only within Chandigarh.

6.2.2 Additional packaging charges apply for orders to be delivered outside the Chandigarh region. Our packaging is designed to ensure that the chocolates reach you in perfect condition for enjoyment.

6.2.3 Kreative Chocolates will not be responsible for delays caused by events beyond its control, including strikes, natural disasters, or terrorism. Shipping times may be extended during busy holiday/festival seasons (e.g., Republic Day, Raksha Bandhan, Independence Day, Ganesh Chaturthi, Dussehra, Diwali, New Year, etc.).

Once the product is shipped it is not returnable and refund is not available.

The purchaser assumes risk of product loss or deterioration once the product is tendered to the delivery service.

8.1 Customer Satisfaction

Kreative Chocolates takes pride in the high quality of its products and service. If you have any feedback or a complaint, please contact us promptly. We will make every effort to resolve the issue, but we need your cooperation to do so. Any damage claims should be clearly described in writing, dated, and signed.

8.2 Claims Process

All claims must be received by Kreative Chocolates within 24 hours of product delivery. Claims received after this timeframe may not be honored.

8.3 Required Documentation for Claims

No claim will be reviewed unless it is accompanied by a written explanation of the issue, including a description of any damages. After reviewing the situation, Kreative Chocolates will, at its discretion, determine the appropriate remedy, which may include a refund or reshipment of the product.

8.4 Limitation of Liability

Kreative Chocolates shall not be liable for any special, indirect, incidental, punitive, or consequential damages, including but not limited to loss of profit, revenue, or other benefits arising from claims hereunder, or for claims made by any third party against the purchaser.

All of our transactions shall be governed by the laws of Chandigarh Jurisdiction  without regard to its choice of laws provisions.
